The couple have just announced a legal settlement with Pfizer over a new lawsuit accusing them of conspiring to steal their share of $8.4 billion in illicit erectile dysfunction drugs, which is not the only issue facing Americans.
The settlement is likely to lead to a number of legal actions, including the recent settlement with the New York-based firm that had begun selling the pills for erectile dysfunction drugs, including Viagra.
In a recent, Pfizer's attorneys argued that the drug companies did not need to file a complaint against Pfizer before settling the issue, but the company still faced a legal challenge.
"Our lawyers will fight to ensure that Pfizer has all the evidence and the legal support that is needed to pursue this settlement," said Joseph A. Bernstein, the co-founder of the New York-based law firm Bernstein Law Group, which represents health care insurers and drugmakers.
The couple had sued the firm for $1 billion in legal damages, including $6.5 million in damages from Pfizer.
The lawsuit, filed on June 27 in the U. S. District Court for the Southern District of New York, alleges that Pfizer had conspired to sell a number of Viagra pills at the company's corporate headquarters in Chicago.
In August 2004, the two-week trial was held before a jury in New York state. The jury in the first case was about $7.5 million, compared with $3.5 million in the trial for the other two cases.
In addition to the Viagra lawsuit, the couple has filed more than 50 separate lawsuits, including one in the U. District Court for the District of New Jersey, claiming that Pfizer knew or should have known about the counterfeit pills and had not disclosed the risks involved.
The suit, filed in the U. District Court for the Southern District of New York, alleges that Pfizer knew the pills were fake and that they could be used to produce pharmaceuticals that are not approved for sale by the U. Food and Drug Administration, or FDA.
"Pfizer knew of the danger," said Bernstein, "and the counterfeit pills did not contain the active ingredient that would be most effective in treating erectile dysfunction.
"Pfizer, in turn, knew or should have known about the potential for harm to individuals and had made its legal argument to the court and to the public."
The plaintiffs in the Pfizer case, known as "the Viagra and Cialis Pills Pills Litigation," claim that the companies marketed the pills, which are made of a synthetic version of Viagra's active ingredient, Sildenafil Citrate, to make it easier for consumers to obtain a prescription for the drug. According to the lawsuit, Pfizer also knew that the pills were fake and that the pills could be used to manufacture pharmaceuticals that are not approved for sale by the FDA, or FDA.
The lawsuit alleges that Pfizer knew about the risks and failed to warn consumers that the pills contained the active ingredient that is sold under the brand name Viagra. As a result, the company had to make a decision to stop sales of the drugs.
The Pfizer lawsuit also seeks to hold Pfizer liable for any and all illegal acts, including the sales of Viagra, that occurred after the alleged scheme was discovered and reported to the federal court.
In addition to the Pfizer lawsuit, the Pfizer settlement also seeks to hold the company liable for all claims, including claims for kickbacks and kickback settlements, filed in the United States District Court for the Southern District of New York.
Pfizer has been sued for illegal agreements that allegedly enabled Pfizer to bypass the FDA, and to sell its pills for ED medications, including Viagra and Cialis. Pfizer has been sued over allegedly conspiring to get drugs for other uses, including over the internet.
According to Bernstein, the companies had to make a settlement offer before the lawsuit was filed.
The case is still under investigation by the federal government, although the companies are still scheduled to file a lawsuit in the United States District Court for the Southern District of New York in November.
